Derivatives jurisdiction dispute escalates between SEC and CFTC
The SEC is conducting a review of its approval of bitcoin options trading on Nasdaq following a challenge from CME. The dispute centers on whether bitcoin derivatives fall under SEC or CFTC jurisdiction. CME's position holds that because bitcoin is classified as a commodity, options contracts tied to its value should be regulated by the CFTC rather than the SEC, creating a direct jurisdictional conflict between the two agencies.
This challenge represents a significant structural question about how crypto derivatives are regulated in U.S. markets. The outcome could establish precedent for how similar products are approved and overseen going forward, particularly as new derivative instruments continue to be introduced.

Legal proceedings tied to the defunct FTX exchange are advancing through the court system. Separately, enforcement actions against alleged manipulative trading practices are underway, including a case resulting in a former congressman being ordered to pay $35,000 for manipulative trading violations.
