State-Level Prediction Market Litigation Creates Legal Uncertainty
Connecticut has filed a new lawsuit against Kalshi, a cryptocurrency-based prediction market platform, joining a series of state and federal court challenges that have produced roughly evenly divided outcomes so far. The patchwork of litigation across multiple jurisdictions suggests fundamental disagreements over regulatory authority and the classification of prediction markets under existing state and federal law.
The courtroom battles have not yet produced clear winners, leaving the legal status of prediction markets in flux. Legal observers note that the volume and geographic spread of cases may eventually require Supreme Court intervention to establish a uniform national standard, as current state-by-state approaches create operational uncertainty for market participants.
