US Regulatory Framework: Derivatives and ETF Classifications in Focus
The CFTC has asked a federal judge to dismiss CME's lawsuit over crypto perpetual futures, characterizing the dispute as inconsequential and noting that its order allows any designated contract market, including CME itself, to list these products. This move signals the CFTC's confidence in its regulatory authority over crypto derivatives.
SEC Chair Paul Atkins has indicated that the Clarity Act is expected to pass this month, pointing toward legislative resolution of ambiguities over which agency oversees different digital asset classes. Meanwhile, crypto industry groups including The Crypto Council for Innovation, Grayscale, and a16z have petitioned the SEC to preserve existing fund classifications and streamline review processes for novel exchange-traded products.
