Legislative Gridlock on Crypto Market Structure
The long-awaited Clarity Act, intended to establish regulatory clarity for digital asset markets, has encountered fresh headwinds following release of a revised draft by Senate Republicans. While Senator Cynthia Lummis, a lead negotiator, expressed satisfaction with the updated version, key Democratic lawmakers stated the bill "falls short" on ethics protections and other safeguards. Market expectations have reflected the uncertainty: odds of the bill's passage fell to 38% according to recent reporting.
The revised draft includes a temporary ethics provision barring Trump administration officials and their spouses from issuing or sponsoring digital assets—though the restriction expires in 2029 and enforcement authority rests solely with the Department of Justice. Provisions protecting non-custodial developers were preserved in the update. Democrats have signaled willingness to negotiate further on ethics and other provisions, but substantive disagreements remain unresolved.
